TERMS & CONDITIONS OF RATHOETOYS

PLEASE NOTE RATHOETOYS IS AN ONLINE BUSINESS ONLY. WE DO NOT HAVE A SHOP FOR VIEWING PRODUCTS.

Like every other internet or mail order retailer, we have no control over problems that occur in transit that lead to delays in delivery of your order. Whilst we completely understand the frustration that delays cause, we cannot be held responsible for any delays caused by 3rd party couriers and therefore cannot offer discounts or compensation for delays in delivery.
We ship via a national courier, which has a delivery time of 2 to 3 days.

We endeavour to process your order as quickly as possible and will usually dispatch your goods within 5 days of receiving the order 10 Days for Trampolines (subject to receiving satisfactory payment, see section 2 below). If an item is no longer available or is out of stock we shall inform you and advise you of the expected delivery time. We may contact you by telephone so please ensure that you have provided us a daytime contact number. By placing an order you confirm that you have provided us the correct billing address of your debit/credit card and the correct delivery address.
We cannot accept responsibility for delays in delivery caused by our suppliers or by any other third party. Hence we cannot be liable for an item that fails to arrive by a required date.

PAYMENT

We accept payments by PayPal which accept all credit cards and Shopify Payments which accepts all major Credit/Debit cards.

We will accept cash if we agree to you collecting your toy from us. This is at our Discretion and we reserved the right to refuse this service if we so choose without reason.

Goods will only be dispatched once full payment has been received and the funds has been cleared. Please allow up to 5 working days for us to process your payment.

PRODUCT DESCRIPTION


We aim to describe each product as accurately as possible. However, where products are made of plastic, this may cause the materials, design and colour to vary from those illustrated. Consequently we cannot be held responsible for any changes to the final product as a result of the above.

Please make sure that you are able to be at home for a delivery if a day/date has been confirmed, as some failed deliveries are liable to re-delivery costs at the Full Rate of our original delivery charges.
 
Please do not reject a delivery if the box is damaged. We do our best to ensure that all of our products are adequately protected during transit, so a damaged box will very rarely result in a damaged product. In the event that your item is damaged PLEASE DO NOT ASSEMBLE A TOY IF IT HAS A VISUAL DEFECT SUCH AS CRACKS OR BROKEN PARTS.WE WILL NOT ACCEPT A TOY ASSEMBLED BACK FOR A REFUND. In such as case please contact us by email rathoetoybox@gmail.com in the first instance so we can advise you in the next step. We will Where possible, ALWAYS replace parts before accepting returns where items arrive damaged or develop a fault that can be fixed with a replacement part. We must be notified within 24 Hours via E-mail (not by Phone)of you receiving your package and may ask for proof of the damage by way of Picture/Pictures before processing your request. A Cooling of Period of 7 days is accepted where a box has been open but you have change your mind. A full Refund will be issued minus the cost of returning the box should you request us to collect the box. Otherwise you pay for returns or can return in person.

DISPLAY ITEMS AS SOLD AS SEEN AND ARE THEREFORE NON RETURNABLE FOR A REFUND.

Cancellation Rights

We are fully compliant with the Consumer Protection (Distance Selling Regulations) Act 2000, which allows for a 7 day "cooling off" period. If you decide to return an item due to a change of mind then you must contact us first by email rathoetoybox@gmail.com anytime up to 7 working days starting from the day of delivery. Once we have confirmed that the goods can be returned, you must ensure that the item returned is unused and in perfect re-saleable condition with all the original packaging and instructions, otherwise we will be unable to refund you. Upon satisfactory receipt of the goods we shall issue a refund for the cost of the goods only, EXCLUDING ANY DELIVERY CHARGES THAT YOU HAVE PAID, either by cheque or the original method of payment. However, YOU WILL BE RESPONSIBLE FOR THE COST OF RETURNING THE ITEM BACK TO US. If our courier collects the item then we shall deduct a collection fee of €20 from the price of the goods and the balance shall be paid to you. If we arrange our courier to collect a box of you and you reject this collection for any reason you the customer are liable or the Non Collection Charged imposed on Rathoetoys by our courier.

If you decide to arrange your own delivery then we would strongly recommend that you obtain a "Proof of postage" certificate from the Courier (free of charge) as this will be required in the event of making a claim for lost or damaged returns.

In the case of personalised products or any item that has been made to your specification, we regret that we are unable to provide a refund on these items. Such items are excluded from the Distance Selling Regulations Act 2000. If you are in doubt about placing an order for a personalised product then please contact us and we will be glad to assist you and provide further details.

DAMAGED GOODS

Our policy on returns does not affect you Statutory Rights as a consumer. If the goods are received damaged then we will offer you a full refund or if you prefer an replacement product. PLEASE DO NOT ASSEMBLE A TOY IF IT HAS A VISUAL DEFECT SUCH AS CRACKS OR BROKEN PARTS. In such as case please contact us by email rathoetoybox@gmail.com in the first instance. Please note that you must notify us of the damage by telephone WITHIN 24 HOURS OF ACCEPTING DELIVERY. We are unable to entertain any claim for damaged goods after this time period. This is a condition imposed by our carriers.

IMPORTANT! Once you assemble an item you are unable to claim against any damage in transit and no returns will be accepted.
Damages during transit must be reported to us within 24 hours of receipt. We cannot assume any item is a gift and as such cannot accept complaints made after this period in the event that the goods were not checked beforehand.

When returning an item back to us please enclose all the packaging, instructions, leaflets etc that came with the product, together with a brief explanation of the fault. If you decide to arrange your own delivery we recommend that you obtain a Proof of Postage when returning the item back to us as we would be unable to refund you the postage costs without this certificate

In the case of personalised products or any item that has been made to your specification, we regret that we are unable to provide a refund on these items. Such items are excluded from the Distance Selling Regulations Act 2000. If you receive such an item that has been damaged then will repair or replace the product. Where this is not possible, a full refund will be offered.

FAULTY GOODS/COMPLAINTS

ALL RIDE ON TOYS ARE UNDER WARRANTY FOR 6 MONTHS FROM DATE OF DELIVERY/COLLECTION OF YOUR TOY.

We want you to be happy with everything you buy from us. If you are not satisfied with your purchase, we will exchange or refund any unused item provided it is returned in a saleable condition,(which means you must NOT have ASSEMBLED THE TOY) in its original, undamaged packaging, and within 7 days from receipt of goods. If we find that the product has not been returned to us in a re-saleable condition, we reserve the right to refuse a refund.

If a product has been accepted as being in good condition by the customer, but is then found to have a fault, our policy is to aim to repair the product via replacement parts being shipped directly to the customer unless this is not possible due to inherent structural faults. No replacement product shall be offered until all other methods of solving the fault have been exhausted. No replacement of any ride on toy will be Entertained after the 6 month warranty has elapsed. We will however provide you with replacement parts for any ride on toy at your expense

Any refunds given will be made via the same method as payment received.

If your product develops a manufacturing fault after 7 days of accepting delivery, but within 6 months, we will aim to repair the product by sending out replacement parts to the customer’s address. If for some reason a replacement toy is needed due to inherent structural faults then the original toy bought by you the customer must be returned to Rathoetoys before sending out the replacement toy. This is to prevent Fraud or miss confusion that may arise if their is any problems with the Replacement toy. 

If a Partial Refund is agreed between Rathoetoys and a customer for whatever reason the refund will be returned the same way that the toy was paid for in the first instance. We reserved the right to hold payment till we Rathoetoys are happy that the situation has been Resolved Satisfactorily at our end not the Customers end. This Does not Affect Your Statutory Rights.

Our warranty does not cover any item that is over 6 months old, unless there is a separate manufacturer’s warranty in place. Please check with us and we shall advise if such a warranty applies to your product.
